PhotoCardMagic provides an AI-powered platform for creating greeting cards and digital invitations, with optional print-on-demand fulfillment. Our services include:
- AI-generated card designs based on your inputs
- Customizable card templates
- Digital invitation creation and management
- Guest list management and RSVP tracking
- Print ordering and fulfillment
- Digital card sharing via email and link
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
4. Credits and Payments
Credits
- Credits are required to generate AI images and send cards
- Credits are non-refundable and non-transferable
- Unused credits do not expire while your account is active
- We reserve the right to modify credit pricing at any time
Purchases
- All purchases are processed securely through Stripe
- Prices are displayed in USD unless otherwise noted
- You agree to pay all charges associated with your account
Refunds
- Credit purchases are generally non-refundable
- Print orders may be eligible for refunds if there are printing defects or shipping issues
- Refund requests should be submitted within 30 days of purchase
5. User Content
Your Content
You retain ownership of content you upload or create. By using our service, you grant us a license to:
- Store, process, and display your content to provide our services
- Use your content with AI services to generate designs
- Share your content with fulfillment partners to complete print orders
Content Restrictions
You agree not to upload or create content that:
- Infringes on intellectual property rights of others
- Contains illegal, harmful, or offensive material
- Violates any person's privacy or publicity rights
- Contains malware or malicious code
- Impersonates another person or entity
- Violates any applicable laws or regulations
6. AI-Generated Content
Our service uses artificial intelligence to generate card designs. You understand and agree that:
- AI outputs may vary and are not guaranteed to meet specific expectations
- AI may occasionally produce unexpected or imperfect results
- You are responsible for reviewing AI-generated content before use
- Generated images may be used for your personal or commercial purposes
- We do not guarantee exclusivity of AI-generated designs
7. Print Orders
For print orders:
- Orders are fulfilled by third-party print partners
- Shipping times and costs vary by destination
- We are not responsible for delays caused by shipping carriers
- Colors in printed products may vary slightly from on-screen previews
- You are responsible for ensuring shipping addresses are correct
8. Intellectual Property
The PhotoCardMagic service, including its design, features, and content (excluding user content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our service without permission.
9. Prohibited Uses
You agree not to:
- Use the service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Use automated tools to access the service without permission
- Resell or redistribute our services without authorization
- Use the service to send spam or unsolicited communications
10. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:
- Your right to use the service will immediately cease
- Unused credits will be forfeited
- We may delete your account data after a reasonable retention period
You may also delete your account at any time through your account settings.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these Terms.
